OVERVIEW
Welcome to BentFace! The terms “we”, “us” and “our” refer to BentFace. BentFace operates this store and website, including all related information, content, features, tools, products, and services (the “Services”) to provide you with a curated shopping experience. BentFace is powered by Shopify, which enables us to provide the Services.
BentFace also operates BentFace Connect, an affiliate and creator referral program managed through UpPromote, a third-party affiliate platform.
By accessing or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy https://enterbentface.com/policies/privacy-policy. If you do not agree, do not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
You must be the age of majority in your jurisdiction to use the Services. You are responsible for maintaining the security of your account and for all activity conducted through it.
Participation in BentFace Connect requires a separate affiliate account, approval, and compliance with these Terms and any rules displayed within the UpPromote affiliate dashboard.
SECTION 2 – PRODUCTS
All BentFace products are print-on-demand and produced only after an order is placed. Product colors and appearance may vary due to screen settings and manufacturing processes.
Product descriptions, availability, and pricing may change without notice. BentFace reserves the right to limit or discontinue products at any time.
SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. Orders are not accepted until payment is processed. Because items are made to order, cancellations may not be possible once production begins.
All purchases are subject to our Refund Policy https://enterbentface.com/policies/refund-policy, including final sale limitations related to print-on-demand products.
Orders are for personal use only and not for resale.
SECTION 4 – PRICING AND BILLING
Prices are subject to change without notice and do not include taxes or shipping unless stated. You agree to provide accurate payment and account information.
Affiliate commissions paid through BentFace Connect do not affect the price paid by customers and are not refunds, rebates, or discounts.
SECTION 5 – SHIPPING
Delivery times are estimates only. BentFace is not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss passes to the customer once the item is transferred to the carrier.
SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services is owned by BentFace or its licensors and protected by intellectual property laws. Use of the Services is permitted for personal, non-commercial purposes only.
SECTION 7 – OPTIONAL TOOLS
The Services may include tools provided by third parties. These tools are offered “as is” without warranties or endorsement, and use is at your own risk.
SECTION 8 – THIRD-PARTY PLATFORMS
BentFace uses third-party platforms, including Shopify and UpPromote, to operate the Services and BentFace Connect. BentFace is not responsible for third-party platform outages, tracking errors, reporting delays, or technical failures.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
All purchases are made directly with BentFace. Shopify is not responsible for transactions or disputes between you and BentFace, and you release Shopify from related claims.
SECTION 10 – BENTFACE CONNECT (AFFILIATE PROGRAM)
BentFace Connect is a referral and affiliate program that allows approved participants (“Affiliates”) to earn commissions by sharing approved links or codes.
Commission Structure
Affiliates earn $5 per qualifying item sold, subject to verification and compliance with program rules.
Tracking & Payouts
Tracking, attribution, and payouts are managed through UpPromote. Affiliates are responsible for maintaining accurate payout and tax information within the affiliate dashboard. BentFace is not responsible for lost commissions due to browser settings, cookies, ad blockers, or third-party platform issues.
Program Control
BentFace reserves the right to approve, deny, suspend, revoke, or terminate affiliate participation, links, or codes at any time. BentFace may modify or discontinue the program or commission structure for future sales without obligation.
Future Incentives
BentFace may introduce additional incentives, bonuses, raffles, pools, or royalty-based opportunities in the future. Participation is optional and not guaranteed, and such programs may be modified or discontinued at any time.
Affiliate participation does not constitute employment, partnership, or guaranteed income.
SECTION 11 – PRIVACY
All personal information is governed by our Privacy Policy https://enterbentface.com/policies/privacy-policy and Shopify’s Privacy Policy.
SECTION 12 – FEEDBACK
By submitting feedback, you grant BentFace a perpetual, royalty-free license to use it without obligation to compensate or respond.
SECTION 13 – PROHIBITED USES
You may not misuse the Services, violate laws, infringe intellectual property, distribute malware, impersonate others, or manipulate affiliate tracking, links, or attribution systems.
SECTION 14 – TERMINATION
BentFace may terminate access to the Services or BentFace Connect at any time. Termination may include loss of affiliate access and forfeiture of unpaid commissions resulting from policy violations.
SECTION 15 – DISCLAIMER OF WARRANTIES
The Services and products are provided “as is” and “as available” without warranties to the fullest extent permitted by law.
SECTION 16 – LIMITATION OF LIABILITY
BentFace and its partners are not liable for indirect, incidental, or consequential damages to the fullest extent permitted by law.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless BentFace and its partners from claims arising from your use of the Services or violation of these Terms.
SECTION 18 – SEVERABILITY
If any provision is unenforceable, the remainder remains in effect.
SECTION 19 – ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and BentFace.
SECTION 20 – GOVERNING LAW
These Terms are governed by the laws of the jurisdiction where BentFace is headquartered.
SECTION 21 – CHANGES TO TERMS
BentFace may update these Terms at any time. Continued use constitutes acceptance.
